Resolution 4/24 – Minimum Wage

By means of Resolution N° 4/2024, the Secretary of Work, Labor and Social Security set forth the new values for minimum wage applicable as from February 1st 2024 (AR$ 180.000) and March 1st 2024 (AR$ 202.800).

Decrees 170/24 and 171/24 – Social Health Care Organizations

By means of Decrees N° 170/2024 and 171/2024, the Executive Branch amends previous regulations such as Decrees N° 576/1993 and 504/1998, both related to Laws N° 23.660 (Social Health Care Law) and 23.661 (National Health Insurance Law). Among others, it is provided that employees (beneficiaries) shall freely choose their affiliation to any health insurance company, and that health insurance companies shall freely increase compensation as long such increase applies to all affiliates even.

Decree 14/24 – PAIS Tax

By means of Decree N° 14/2024, the Executive Branch exempts from “PAIS” Tax the import of goods destined for the production of exportable goods.

General Resolution 992/24 – Financial Trusts

By means of General Resolution N° 992/2024, the National Securities Commission (CNV) modified the regime applicable to financial trusts with public offering of their securities.

General Resolution 5484/24 – Customs in Advance Resolution Queries

By means of General Resolution N° 5484/2024, Tax Enforcement Authority (AFIP) set forth the procedure for the filing of custom in advance resolutions queries by interested parties (importers/exporters) seeking for legal certainty regarding the technical customs criteria which shall govern a certain and specific future import or export operation. AFIP’s pronouncement to the query shall be valid for a 3 years term, unless the regulations or circumstances according to which the pronouncement was issued, change.

Resolution 9/24 – Applicable Terms for “MiPyMEs” Invoices

By means of Resolution N° 9/2024, the Ministry of Economy set forth that as of March 1st, 2024 to October 31th, 2024, the term applicable to payment, acceptance and/or rejection of invoices issued by Small and Medium Companies registered as such (MiPyMEs), shall be of 21 running days.

General Resolution 1/24 – Expiration Term for Companies

By means of General Resolution N° 1/2024, the Superintendence of Corporations (“IGJ”) abrogates previous General Resolution N° 1/2022 which provided that company’s by-laws, upon incorporation, shall provide a maximum duration term of 30 years

General Resolution 2/2024 – Company’s Social Corporate Purpose

By means of General Resolution N° 2/2024, the Superintendence of Corporations (“IGJ”) modifies previous General Resolution N° 7/2015 now allowing companies to register multiple social corporate purposes, whether these are related or not. Also, the Resolution abrogates the requirement to adapt the amount of capital stock to company’s corporate social purpose.

Resolution 10/24 – State Supervision over Companies

By means of Resolution N° 10/2024, the Ministry of Justice update and raise to Two Thousand Million Pesos ($ 2.000.000.000) the amount of company’s stock capital upon which companies become subject of state permanent supervision and audit in the terms of section 299 (subsection 2) of Corporate Law N° 19,550.

Resolution 5/24 – Price of Biodiesel

By means of Resolution N° 5/2024, the Secretariat of Energy set forth a new minimum price for the acquisition of biodiesel destined for mandatory mixture with diesel (under Law 27,640), applicable to operations performed as of February 1st, 2024.

Resolution 6/24 – Price of Bioethanol (sugar cane and corn)

By means of Resolution N° 6/2024, the Secretariat of Energy set forth a new minimum price for the acquisition of bioethanol obtained from sugar cane and corn destined for mandatory mixture with petrol (Law 27,640), applicable to operations performed as of February 1st, 2024.
